Welcome to DIWA. These Terms of Service ("Terms") apply to your use of diwamag.co, our newsletter, our shop, and our events (together, our "Services"). By using our Services, you agree to these Terms. If you don't agree, please don't use our Services.
About DIWA
DIWA is a Filipino American cultural storytelling publication and community events platform based in Portland, Oregon.
Using Our Website
You agree to use our Services only for lawful purposes. You agree not to:
• Interfere with or disrupt our website or its security
• Copy, scrape, or reproduce our content except as allowed by these Terms
• Submit anything false, harmful, harassing, or infringing on anyone else's rights
Our Content
All content on our website and in our publications, including articles, photographs, illustrations, graphics, logos, and design, is owned by DIWA Media Holdings, LLC or its contributors and is protected by copyright and trademark laws. You may share links to our content and quote brief excerpts with credit to DIWA. Any other use requires our written permission.
Your Submissions
When you submit a story, photo, comment, or other content to DIWA Media Holdings, LLC, you confirm that it's yours to share and that it doesn't violate anyone else's rights. You keep ownership of your submission, but you grant DIWA a non-exclusive, worldwide, royalty-free license to edit, publish, display, and share it in our publications, website, social media, and promotional materials. We'll contact you before publishing a story submission. We may choose not to publish any submission at our discretion.
Tickets and Purchases
• Pricing and availability: All prices are listed in U.S. dollars and may change without notice. Tickets, add-ons, and merchandise are available while supplies last.
• Fees: Ticketing and processing fees may apply and will be shown at checkout.
• Refunds: All purchases are subject to our Ticket Refund Policy.
• Order errors: We reserve the right to cancel orders affected by pricing errors, suspected fraud, or availability issues, with a full refund.
Donations
Some DIWA events raise funds for nonprofit partners. Donations made directly through a nonprofit's fundraising page are governed by that organization's terms. Donations collected through our shop are passed to the designated nonprofit. [DIWA is not a registered 501(c)(3) organization, so donations made through our shop are not tax-deductible through DIWA.] Donations are non-refundable.
Attending Our Events
By attending a DIWA event, you agree to:
• Treat fellow guests, performers, artists, staff, and venue teams with respect
• Follow the rules and policies of the venue
• Follow all applicable laws, including those governing alcohol. You must be 21 or older to purchase or consume alcohol, which is sold and served by the venue.
DIWA and our venue partners may refuse entry to, or remove, anyone whose behavior is disruptive, unsafe, or harassing, without a refund.
Event details, including times, programming, and participating artists, may change. Photography and recording at our events are covered by our Photography & Media Release.
Assumption of Risk
You attend DIWA events voluntarily and at your own risk. DIWA is not responsible for lost, stolen, or damaged personal belongings.
Third-Party Services and Links
Our Services may link to or use third-party services, including ticketing and payment platforms, venues, sponsors, and nonprofit partners. We're not responsible for their content, policies, or practices.
Disclaimers
Our Services are provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee that our website will always be available, uninterrupted, or error-free.
Limitation of Liability
To the fullest extent permitted by law, DIWA and its founders, organizers, partners, contributors, and volunteers will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services or attendance at our events. Our total liability for any claim related to a purchase will not exceed the amount you paid for that purchase.
Indemnification
You agree to indemnify and hold harmless DIWA and its founders, organizers, partners, contributors, and volunteers from any claims, damages, or expenses arising from your violation of these Terms or your submissions.
Governing Law
These Terms are governed by the laws of the State of Oregon. Any disputes will be resolved in the state or federal courts located in Multnomah County, Oregon.
Changes to These Terms
We may update these Terms from time to time. When we do, we'll post the new version here and update the effective date. Continued use of our Services means you accept the updated Terms.
